A guardian may be appointed for numerous reasons, typically associated with the mother and father being unable or unwilling to care for the children. Sometimes their inability will be temporary and sometimes permanent. If the Delaware Department of Family Services believes the parents cannot care for their child, DFS will petition the court to appoint a guardian and the parent has the right to oppose the state at a hearing.</p>

You need an experienced attorney to properly represent your parental rights while taking into account the best interest of your children. The court may award <strong>Sole Custody, </strong>where the parent with sole custody makes all of the decisions for the child, or <strong>Joint Custody,</strong> where major decisions regarding the welfare of the children are agreed to jointly by both parents. One parent will have primary residence with visitation by the other parent. This visitation can vary from every other weekend to every other week.</p>

<p>To be eligible for an expungement , you must have no record of conviction. If you plead guilty or were found guilty of a charge, it cannot be expunged. Probation Before Judgment (PBJ) is <em>not</em> a conviction (unless you violated it). We can also assist you in getting a conviction pardoned, if that is your situation.</p>
<p>However, if you were convicted of underage entry into a liquor store or tavern, OR underage possession or consumption of alcohol, the law now provides that you may have that record expunged <em>when you reach the age of 21</em> AND <em>if you have no other record.</em></p>
<p>To determine if you are eligible for an expungement, you will need a certified copy of your criminal record. We will guide you through the process of obtaining this certified copy. This copy will provide information as to whether you are eligible for a <strong>mandatory</strong> or a <strong>discretionary </strong>expungement.</p>
<p>If your expungement is classified as <strong>mandatory,</strong> we will file your request and it should be final in a few weeks or even a few days.</p>
<p>If your expungement is classified as <strong>discretionary</strong>, we will prepare and present your petition to the Court. This process is more lengthy and can take several months for a ruling.</p>
